In terms of ECTA, electronic contracts are legally binding provided that certain conditions are met. 5. PRODUCT DESCRIPTIONS & PRICING

We make every effort to ensure that product descriptions, images, and pricing are accurate. However:

6. ORDERS & PAYMENT

All orders are subject to availability and confirmation. We reserve the right to refuse or cancel any order at our discretion.

7. DELIVERY & FULFILMENT

8. COOLING-OFF PERIOD

Since Babywise SA sells goods through direct marketing online, you have the right to cancel your order within 5 business days of receiving your goods — without penalty and without providing a reason. You are responsible for the cost of returning the goods during this period. Temu

9. RETURNS, REFUNDS & WARRANTIES

In terms of Section 56 of the Consumer Protection Act, we provide an implied warranty of quality. 10. PERSONALISED PRODUCTS

Orders for personalised items — including our toddler tableware sets — are made to order based on the specifications you provide at checkout. Please verify all personalisation details carefully before completing your order. Personalised products are non-returnable and non-refundable unless they arrive defective, damaged, or do not match the specifications you submitted.


11. INTELLECTUAL PROPERTY

All content on babywisesa.co.za — including but not limited to logos, product descriptions, images, copy, and design — is the intellectual property of Babywise SA. You may not reproduce, distribute, or use any content from this website without our prior written consent.


12. LIMITATION OF LIABILITY

To the fullest extent permitted by South African law, Babywise SA shall not be liable for:

  • Any indirect, incidental, or consequential loss arising from use of our website or products
  • Delays caused by courier services, customs, or circumstances beyond our reasonable control
  • Loss or damage arising from your failure to provide accurate order or delivery information

Nothing in these terms limits your statutory rights under the Consumer Protection Act or any other applicable South African legislation.
